Dr. Laura, Sarah Palin, and the fight over free speech

In the wake of Dr. Laura Schlessinger’s decision to end her radio show after repeatedly using a racial epithet, she’s spent quite a bit of time talking about freedom of speech. “I want to regain my First Amendment rights,” Schlessinger said, contending that special-interest groups were limiting her freedom to express herself.

Sarah Palin jumped in and tweeted, “Dr.Laura: don't retreat ... reload! (Steps aside bc her 1st Amend.rights ceased 2exist thx 2activists trying 2silence"isn't American,not fair")"

That was soon followed by a second tweet:

“Dr.Laura=even more powerful & effective w/out the shackles,so watch out Constitutional obstructionists. And b thankful 4 her voice, America!)"

Have Dr. Laura’s rights been trampled? Are her critics undercutting the Constitution?

The answer can be found in the First Amendment itself. Though Palin speaks frequently of the need to protect the Constitution and elect politicians who understand it, in this case she is misreading the amendment and how it works.

Here are five facts about Dr. Laura and the First Amendment:

The First Amendment protects us from the government, and not from other Americans who disagree with what we have to say. “Congress shall make no law” — the first five words of the First Amendment — say it all: No government body can limit our rights to speak out. In this case, there’s no government action, just public outrage and pressure.

Boycotts are also protected by the First Amendment. Dr. Laura complains about being “bullied” by those who might pressure her radio affiliates or advertisers, but boycotts are a time-honored use of the First Amendment to address perceived wrongs and have played a role in virtually every social movement in American history.

Efforts to punish controversial speech comes from the right and the left. It’s true that liberal organizations are attacking Dr. Laura for use of the racial epithet, just as conservative organizations burned Dixie Chicks CDs when Natalie Maines told a London audience that she was embarrassed that President Bush came from Texas. Politicians and interest groups of all stripes consistently seek to limit the other side’s free speech.

The marketplace of ideas and the marketplace are different things. We tend to take a romantic view of a nation in which we’re all free to speak, which thereby enriches “the marketplace of ideas.” In the marketplace, however, economic rules apply. Controversial comments can be rewarded with a growing audience or punished by unsettled advertisers. Speech is free; airtime is not.

Dr. Laura’s First Amendment rights are alive and well. Although she’s leaving her radio show, she says she’ll continue to share her views through public speaking, TV interviews, in print, online, and in a new book due in January, all made possible by the First Amendment.

    I'd like to see some more real quotes from the First Amendment here. Can't be too legitimate without a relatively good number of citations.
    Not a good article at all, I'd say.

    Dr. Laura is is a money grubbing "ho." Its pretty obvious with what we know now in January 2011 about this event in August 2010 makes it clear that Laura did this on purpose - It got her out of her existing broadcasting contract, which cleared the way for her "channel on Sirius/XM, and got her a truckload of free publicity which, in turn, brought out a lot of the misinformed (liars) like Sarah Palin. Also humorous is the fact that Laura basically ripped Sarah a "new one" previously ... seems she doesn't like the "momma drizzly" too much at all.

    What word did she use? I can think of 10 or 15 "racial epithets" right off the top of my head.

    Words don't have actual power, only the symbolic power that we as people associate with them.

    Want to know how I would handle this situation? STOP. Stop giving the slur the power to hurt you. Stop acknowledging that it "has power" over you. And realize that while not everyone may agree with you, like you, want to know you... they may even hate you. That shouldn't change your inner-sense of self, and of worth.

    She should be free to use whatever slurs she chooses. I am free to change the station.

    But the fact that journalism has become so stifled that an article about using a "racial epithet" isn't even allowed by socially accepted construct to quote what word was used? That's just ridiculous.

    The first amendment protects us from the GOVERNMENT and not other people, if she couldn't handle what she got then it was her own fault for saying it. Everyone has a different opinion as to whether what she said is right or not and that must be taken into consideration.

    I am mixed and I think people need to get over this. I forgive Dr. Laura, we all make mistakes, she deserves a second chance.

    i'm a white person and i've worked my @#$% off all my life to make a livin and have what i've got. miniority's run up in your face always wanting what they think they're intitled to. some never work in their whole life, just take. i remember the ole sayin give them an inch and they will take a mile. just so you miniorties know i'll never take a back seat or step back in line for ya..if you want up frt. earn it...get a job and quit bitchin...

    Good ol' Dr Laura. The lady who has nudes on the internet, changed her religious faith but hates others who change their sex. figures she has a right to say anything no mater how hurtful and complains when she is told that.

    Old saying, "If you can not take the heat, stay out of the kitchen". She aparently does not know how to cook.

    When laura states that black people voted for Obama because he is black, she fails to realize that many people did NOT vote for him because he is black; some blacks and whites did NOT vote for him because he is also multiracial; just like many people don't listen to laura because she's a jew.

    How about if NO ONE USES THE "N"-word EVER ? How about ZERO TOLERANCE for that one word ? What if to use it was seen as on par with HATE CRIMES [WELL, MISDEMEANORS at least] ? I have believed for a while that the "N"-word should not really be spoken by any non-AfricanAmerican person anyway, but maybe the time has come to censor/banish the word entirely. The best thing Rodney King ever did/ said was "CAN'T WE ALL JUST GET ALONG ?" . Is it not true that a little tolerance goes a long way ?
